Typical informed consent not good enough -- Lewkovich

In these post-apocalyptic times the ordinary “informed consent “[IC] form is not up to date according to PI Guru Gary Lewkovich.

Every state requires that patients be given the IC form.

California has a double requirement: written notice and verbal.

Most often missing is cautioning the patient from the risk of prematurely discontinuing care. Each patient needs to understand that Trauma is Different. Have your patient read and sign the IC form after your explanation. This effort alone will enhance patient cooperation.

I recently received an email from a DC who was concerned because an attorney had brazenly informed him that he contacted the patient’s insurance company and requested that the med pay checks for billing by the DC be sent to the attorney’s office.

The attorney was depositing them into his trust account and would, no doubt, be using that tactic to negotiate the DC’s bill when the case resolved. That, I explained to him, is fraud. Together we worked on putting a letter together to the attorney explaining that med pay is for medical payments only and it would be fraudulent for the attorney or the client to receive any of that money. I’ll let the good doctor explain what happened next…

Diana was rear-ended in the city of San Bernardino. Three days later she sought care with a chiropractor. The chiropractor also recommended a series of acupuncture visits.

Diana complained of knee pain and was diagnosed with a meniscal tear and an aggravation of pre-existing condition [but asymptomatic before the accident]. Her DC continued care but referred her to an orthopedist for her left knee. Neither knee therapy nor cortisone shots helped. Even arthroscopic surgery failed. Two orthopedists recommended a total knee replacement. Diana was in constant knee pain.
