Low Offer Costs "Bad Faith" for Defendant

On June 16, a clear, sunny, and warm day, Lucas was stopped for traffic on PCH while returning to work. Unfortunately, Lucas was rear-ended at the intersection of Sunset Boulevard in West LA by a Jeep.

Defendant admitted liability but disputed the extent of Lucas’ injuries. During trial, the insurance MD admitted - under oath - that Lucas suffered “soft-tissue” injuries. However, defendant’s attorney in closing argument stated that all injuries were a result of age degeneration. Lucas is 24 years old.

Lucas claimed neck pain with radiculopathy down both arms, low back pain with sciatica down his leg, hot feet, numbness, and tingling with incontinence for a short period of time.

Total medical bills were $42,922.61. Lucas demanded the policy limits of $100,000. Defendant refused and offered to pay $25,001 instead.

The case went to jury, which awarded Lucas $197,394.79. Because the verdict exceeded the policy limits of $100,000, the Court awarded more money for trial costs and interest, which totaled $274,812.85.
