Robert went with his wife to his local AMC theatre for a matinee. It was raining earlier and staff directed them to a path delineated by stanchions to enter the theater and purchase tickets. The path was over a slippery terrazzo floor.
Robert slipped and fell, suffering nerve injury at C5-7, that required a two-level fusion, and a partial rotator cuff tear.
Defendant claimed Robert that they were not negligent because one mat was enough. Plus, Robert did not suffer significant injuries and all his physical problems were pre-existing.
Robert demanded $ $849,000 before trial. Defendant's final offer before trial was $50,000.
The jury awarded a total of $1.8MIL to Robert but reduced his award by 25% for his comparative negligence to a total of $1,357,500. The jury polled was 9-3.
