Q We have a wellness practice and do not do many PI cases. An attorney referred us a PI. We worked hard and billed $6500. We got good results. I contacted the attorney and he told me he was fired by the patient. The new attorney refused to sign the lien. He offered me only $1200. What can I do?

A The first attorney lost all control over your PI when he was discharged. Unless you get the new attorney to sign your lien you have virtually no contractual guarantees. Here's what I suggest :

	1.	Contact your patient ask them to get the new attorney to sign your lien.
	2.	If not, bill your patient immediately. Since there is no lien the patient's bill is due, immediately.
	3.	Given that your bill is under the Small Claims threshold, you could file to remind your patient you are serious and not operating a 'free clinic'.
	4.	Sadly, “changing the attorney syndrome” can hurt honest doctors.

Last issue we noted that Defense Chiropractor Brian Kileen testified against a treating DC. We find yet another case this time down in San Diego.

Facts: Mr. Torres broadsided another vehicle that turned left in front of him. Not reported is whether the air bag was deployed. Crucial.

Defense argued that Torres was partially responsible, for not noticing that the defendant was waiting to turn left.

Torres was treated for back pain. Defense claimed that the care was unjustified.

After a three day trial, the Jury weighed the evidence for 5 hours. They found Torres was 100% innocent. And promptly awarded him $15,663.
