A San Fernando Valley doctor was subpoenaed to testify at a Mediation. The doctor showed up and waited 3 hours and the case was mediated by the court without the doctor being present, while he waited the case was settled during mediation. The doctor asked the PI lawyer when he would get paid. The PI lawyer told the doctor to ‘send him the bill.” The chiropractor asked for ½ day fees, as he closed his office that morning. The Lawyer stiffed him.
The first time I testified to the Ca legislature was on this topic. A reform law passed entitled the {…other health care providers …} when asked to express and opinion must get paid as an expert.
Code of Civil Procedure Section 2034.210
Anytime any lawyer wants your expert opinion: diagnosis, prognosis etc. in a deposition, mediation, arbitration or trial you must be paid as an expert. Before testifying negotiate your fee with the asking attorney and get paid in advance.
