ACCESS GENERAL: BANKRUPT - CEASE ALL CALIFORNIA BUSINESS OPERATIONS
|
Department of Insurance [DOI] California Insurance Commissioner Dave Jones issued a Cease and Desist Order against automobile carrier, Access General. AG has a terrible
reputation for not settling cases or not even negotiating.
Finally, the DOI determined that AG is “unable to demonstrate it has the assets
and capital to sustain its business as an insurer.”
If you have an outstanding claim with AG contact your PI attorney to see if he plans to file a CIGA claim to eventually get paid.

Don't split your patient's charts! Otherwise, you could find yourself
in trouble.
Once in PI litigation, DCs receive vague and broadly-worded records subpoenas seeking all of Patient X’s medical records and billing records going back some number
of years.
Sometimes, out of a desire to hide preexisting conditions or justify PI versus cash/insurance billing or simply due to not reading closely, DCs will produce only
the PI chart and withhold the patient’s previous records.
That’s a big problem and defense attorneys will notice.
Defense attorneys have an absolute right to get 100% of your patients’ records. If you ONLY give the most recently PI records you are breaking the law.
In summary, while it sometimes seems counterintuitive to show the opposing insurance company your medical and billing records from prior treatment, the detriment
is far outweighed by the potential damage to a case and to your reputation when they discover it on their own.
Remember, if you have any questions about a subpoena you receive, do not hesitate to reach out for a quick review.

BEWARE OF PHONY PI MARKETERS
|
A new firm is robo calling to lure DC’s into a website and promises 40 new PI patients a month. You have to pay some $1500 plus another fee for social media ads.
They also promise you exclusivity to specific regions. However, we have evidence that another doctor received the same “exclusivity” across the street from one participating
doctor.
Sadly, our contact doctor told us he received 6 Medi-Cal patients plus his social media page was hijacked by this firm.
Tip: If it is too good to be true, it probably is.

Introducing the Hamilton Anxiety Rating Scale: [HAM-A]
This 10-minute rating scale helps access the severity of symptoms of anxiety.
Anxiety is a common symptom in MVA. However, anxiety is seldom mentioned in the PI Report.
The solution is to use a well-established scale to help measure the extent of the symptom.
