Mark, 68 and retired, was driving in San Diego. Mr. Li turned in front of Mark causing an accident.
Defendant admitted fault. Mark presented $58,000 in total medical bills for pain management and concussion care. Mark also claimed future bills of $640,000 for future surgeries. Mark demanded over $1,000,000.
The damaged cars were moderate. Defendant claimed that Mark suffered several pre-existing medical issues that he tried to hide from the jury. That before the accident, doctors suggested he would eventually need back surgery. In addition, Mark failed to mention that he caused a much bigger accident 2 years earlier where he was hospitalized.
Still, the jury gave Mark $107,475:
$57,475 for past medicals and $50,000 for pain and suffering.
