Yvonne’s car was rear-ended in Los Angeles. The defendant even admitted fault.
The two issues that went to trial were the chiropractor care reasonable and necessary and was Yvonne’s Double Vision credible.
Yvonne claimed her chiropractic care was essential and gave her substantial relief despite continuing back pain.
Defendant argued that despite a right orbital blowout fracture, that the injury was temporary and her pain exaggerated.
Defendant suggested to the jury that the award ought to be limited to $76,000 for past medical bills and $400,000 for future general damages.
Plaintiff expert witness, a neuro-ophthalmologist, testified that Yvonne would require two more eye surgeries which should allow Yvonne to return to work and drive a vehicle. However, her MTBI would require additional care.
The Jury awarded $802,836. It was upheld by Judge Michele Flurer of The Los Angeles Superior Court on Nov 1, 2022.
