Decedent Vincent Fitzgerald, age 59 a facilities manager was diagnosed with Graves disease. He underwent radiation iodine treatment killing his thyroid gland. He was prescribed Synthoid, a synthetic thyroid replacement therapy.
In May 2009, his new Kaiser endocrinologist prescribed 200 mcg of Levothroid. 33 days later Fitzgerald returned complaining of “worsening chest pain and pressure.” He lost 11 lbs, his heart was elevated from 72 to 97 and his cholesterol was measured at 302. The doctor reduced the Levothroid to 137 mcg per day. The next morning decedent died of a massive heart attack.
Decedent’s family demanded $950,000. Kaiser offered $700,000. The arbitration result was $1,274,204.
