Study Finds Decline in Medical Malpractice Claims

Researchers from Brigham and Women's Hospital found paid medical malpractice claims in the US declined in the last two years.
 
Claims for all specialties are declining. Neurosurgery pays the most in claims. Dermatologists the least.  Most common among malpractice claims are: misdiagnosis (31.8%), errors related to surgery (26.9%), mistakes related to treatment (24.5%). Some 32% involved patient death.

Doctor of the Month: Garry Kraft DC QME - Big Ventura Verdict


A gay 23-year-old Hispanic fast food worker was rear-ended on the 101 Freeway in Ventura. She was on her way to work but was hit by a Ford 150. It was a big visual impact. Defendant tried to exclude the pictures for the jury but was denied.  The defendant, a 3x convicted felon, was not injured. However, the judge would not allow the jury to hear that defendant was a felon and had to wear handcuffs to court each day---they were removed each morning before the trial began.
 
An ambulance took away the plaintiff to the local hospital. Her HMO doctor referred her to physical therapy. She could not work.
 
She then sought care from Garry Kraft for conservative chiropractic management. After slow progress Dr. Kraft referred her to Dr. Scheinberg, an orthopedic surgeon for evaluation. After two years, conservative management did not work and the plaintiff sought surgical intervention with a L4/L5 laminectomy.
 
Defense argued that surgery was unnecessary and her back pain went away from a placebo effect.
 
The offer before trial was $250,000. Medical expenses were $159,043.65. Future medicals $550,000. Past LOE $645,640. Future LOE $25,000.
 
The jury awarded $1,090,716. Judge Biao presiding. Ventura County Superior Court. March 2017.
PRACTICE TIPS
  • Be aware that Big Impacts often cause Big Injuries. Always get the pictures.
  • Even young people (23) can suffer extreme back pain requiring surgery.
  • Juries want victims to try conservative care - Chiropractic first. When the issue is organic and continuous pain-then the jury will agree, surgery may be necessary.
Beware of the phony lien cutting fraud: "DC's only get 50% of net proceeds in PI"

At our recent seminar in the Bay Area a DC friend showed us a letter from an attorney Mr. K.

 

The attorney wrote he needed to dramatically cut the chiropractor's lien because of a poor settlement. That may be true. But in the letter the attorney did not OFFER to cut his fee.

 

Instead, he deliberately misstated the law and cited Civil Code Sections 3040 - 3045, to justify reducing the DC fees. Those code sections are not applicable to private liens from doctors. And the attorney knows it.

Don't get fooled. We told our doctor friend to stand his ground and demand a full fee or he would take the attorney and his client to the Small Claims and file a complaint with the State Bar.
